Booking Terms & Conditions

Booking Procedure

Active Madeira Ltd follows the booking conditions as set out by ABTA.  The following booking conditions reflect our commitment to our policy of fair trading and our responsibilities under law.

Booking Restrictions

  • All participants of Active Madeira holidays must be at least 12 years old at the time of booking.
  • Bookings can only be accepted from participants aged 18+.
  • All participants aged between 12-17 must be accompanied for all Active Madeira activities by their parent/guardian of 18+ years old
  • All participants (parents, if participant is under 17) must sign stating that to the best of their knowledge they are mentally and physically fit and healthy at the time of booking.  The ability to swim 25 metres is an advantage but not obligatory due to life jackets being provided for water activities.
  • All participants must agree to abide by any decision or instruction given by the Active Madeira Activity Guide/Principal.
  • Minimum groups of four people, to a maximum of six.

Prices

All prices quoted and those shown on your confirmation invoice are in Pounds sterling.  The basic price includes:

  • Self catered accommodation at ‘A Vigia’ in Arco da Calheta, Madeira as discribed on www.activemadeira.com.
  • Transfers to and from the airport at Funchal and your accommodation.
  • Transfers to and from each activity
  • Two complimentary evening barbeques.
  • Provision of sea kayaks, mountain bicycles, life jackets, cycle helmets

What’s Not Included

  • Flights to and from Madeira
  • Holiday insurance
  • Food and drink, accept for two complimentary BBQ’s
  • Costs of entrance fees for tourist attractions and rides during sight seeing activities
  • Excursions outside of range of Active Madeira activities and personal expenditure
  • Taxi fares
  • Passport and visa charges
  • Suitable clothing for Active Madeira’s multi activities, except life jackets and protective helmets.

Special Requests

Special requests are not guaranteed, but we will always do our best to comply with any such requests, provided they are made in advance of your departure.

Booking Confirmation

We require written confirmation that you would like to book.  Email is sufficient.  You will then receive electronically or by post if preferred a booking form, including our booking terms and an invoice for your holiday detailing when payment is required.  The completed booking form must be sent back to us along with your initial payment to secure your booking.  We confirm our receipt of your payments.

Payment

If you book more than eight weeks before your holiday, we require a deposit of £150 per person.  The balance is then due eight weeks prior to the first day of your Active Madeira holiday. If you book within ten weeks of your Active Madeira holiday, we require full payment at the time of booking.  Your holiday may be cancelled if you fail to meet these conditions, at which point relevant cancellation charges would apply.  We do not send out a reminder invoice for your balance of payment.  We can only accept payment by cheque or bank transfer. Payment must be made in Pounds Sterling. A security deposit of £250 per party is required with the balance of payment.  This sum is refundable in full providing there has been no damage or loss to the accommodation or its contents.   The deposit is refunded by cheque or bank transfer on your return to your country of residence.

Amendments to your Booking

If you want to change your booking details in any way we will try to help you, however we cannot guarantee we will be able to do this as other bookings may preclude our flexibility.  All requests for changes to bookings must be made in writing in advance of your holiday.  If you change the number of people in your booking, your holiday price will be recalculated for the new party size and you will be re-invoiced accordingly.

Cancellation

Once your holiday has been confirmed cancellation charges will apply.  Cancellation charges are dependent upon the length of time prior to your holiday commencement that the cancellation is made.  All cancellations must be notified in writing and sent by Recorded Delivery to our address.

In addition to the above, if one or more of your party cancels, we may add a supplement to cover the cost of under-occupancy of the house.  If any member of your party is unable to travel, no-one else may take their place without written confirmation of the name change.

Insurance

We strongly recommend that you take out holiday travel insurance that will include cover for our multi-activities. 

If We Change Your Holiday

In the unlikely event that we needed to make any changes to your holiday accommodation, we would notify you in writing in advance of your departure, providing details of alternative accommodation of a similar standard and in the same resort.  Providing we meet these criteria, you will have no rights to compensation or free cancellation.

If we were unable to run your guided activities due to incapacity of our guide, we would offer you the accommodation at our prevailing accommodation only rate and refund the difference against the price of your original holiday.  Should you decide not to accept these new arrangements, you may cancel your booking within 3 days of the notification thereof or within 2 days of the notification thereof if the departure in within 7 days.  We will then refund all monies paid to us by you.  No additional payments will be made.

Our Liability to You

We accept full liability for illness, injury or death to yourself or anyone in your party only if it is a result of negligence by any of our staff while acting in the scope of, or in the course of their employment with Active Madeira.  We will not be liable should you or any member of your party suffer illness, bodily injury or death through any misadventure arising from an activity which does not form part of your holiday arrangement with us, but we will offer general assistance where we can. We will not be held responsible or liable for any damage to property sustained by participants on an Active Madeira holiday.  We can also not be held liable due to unusual or unforeseeable circumstances beyond the control of our Activity Guide/Principal, the consequences of which could not have been avoided even if all due care had been exercised.  We shall not be held responsible for missed flights on return transfers.  Clients must determine and prepare for their own departure times.  Nothing in this condition shall apply when the service in question consists of your carriage to and from Madeira, whether it be by air or sea.  These obligations and liabilities are provided by international conventions governing air and sea carriers.

Force Majeure

We cannot accept liability in any circumstances where and or/prompt performance of our obligations is prevented by reason of war, riots, civil strife, terrorist activities, industrial disputes, natural and nuclear disaster, fire and adverse weather conditions.

Behaviour

You must accept responsibility for the proper conduct of your and your party. In cases of serious misconduct we reserve the right to terminate your holiday or aspects of your holiday and if we do so we shall have no further responsibility to you.  If you wilfully damage through negligence the accommodation or the sporting equipment provided to you for the purpose of your holiday with Active Madeira you agree to indemnify us against any claim including cost made against us.  In addition you will also loose all of part of your security deposit paid in advance of your holiday.

Holiday Accommodation and Activities

Our descriptions and pictures of the accommodation and activities are as accurate and up-to-date as possible and are based on first hand experience.  From time to time we may need to alter some of the routes taken on our activities as a result of unsuitable weather/sea conditions; general conditions of the terrain or disruption caused by development/construction work.  You should accept that such changes are made for you safety.

Dispute Procedure

We are committed to offering you the best holiday possible, but in the unlikely event that a problem should arise, we would ask you immediately to contact our Activity Guide/Principal in Madeira so that we may attempt to resolve the matter on the spot.  Failure to notify us in Madeira of any dissatisfaction within the fixed period of your holiday will exclude our liability in the alleged cause.  If the problem cannot be sorted out amicably there and then, you must ensure that you detail your dispute in writing and send it to our UK address at the earliest opportunity but within 28 days of your return to your country of residence.  We will respond to you within 28 days of receiving your letter and your complaint may be referred to the arbitration scheme devised for the travel industry by the Chartered Institute of Arbitrators if the customer wishes. Booking conditions shall not deny the client the option of taking action in the courts if they so wish.
